Appendix A: Copyright

Respect for the intellectual work and property of others has traditionally been essential to the mission of colleges and universities. Any use of electronic resources or other duplicating facilities by LU students, faculty, or staff that does not adhere to U.S. Copyright Law is strictly forbidden and subject to disciplinary action.

Provided below are select relevant points, regarding U. S. Copyright Law. These points, however, are not intended to reflect all aspects of applicable Copyright Law.

1. Unauthorized copying, displaying or distributing materials is forbidden unless covered by "Fair Use," as outlined in section 107 Title 17 of the U.S. Code. Be advised that there are no such "Fair Use" exemptions regarding software. Each software program's license must be investigated to determine how and were the application is to be installed and used.
2. U.S. Copyright Law provides consideration for educational use, so called "Fair Use," for copyrighted materials other than software. The following guidelines are taken directly from the U.S. Code.

Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include -

1. The purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
   2. The nature of the copyrighted work;
   3. The amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
   4. The effect of the use upon the potential market for or value of the copyrighted work.
2. The owner of the material determines how or even if, their work can be used or reproduced. Any User desiring to copy, display or distribute any copyrighted materials must determine whether permission from the owner is needed. The copyright owner may set conditions such as length of usage or amount of fee.
