Student Conduct Code

Article I: Definitions

  1. The term University means Lincoln University.
  2. The term student includes all persons taking courses at the University, both full-time and part-time, pursuing undergraduate, graduate or professional studies. Persons who are not officially enrolled for a particular term but who have a continuing relationship with the University are considered students.
  3. The term faculty member means any person hired by the University to conduct classroom activities.
  4. The term University official includes any person employed by the University, performing assigned administrative or professional responsibilities.
  5. The term member of the University community includes any person who is a student, faculty member, University official or any other person employed by the University. A persons status in a particular situation shall be determined by University Rules and Regulations.
  6. The term University premises includes all land, buildings, facilities and other property in the possession of or owned, used or controlled by the University (including adjacent streets and sidewalks).
  7. The term organization means any number of persons who have complied with the formal requirements for University recognition.
  8. The term hearing body means any person or persons authorized to determine whether a student has violated the Student Conduct Code and to recommend imposition of sanctions.
  9. The term shall is used in the imperative sense.
  10. The term may is used in the permissive sense.
  11. The term policy is defined as the written regulations of the University as found in, but not limited to, the Student Code, Student Handbook, and Graduate/Undergraduate Bulletins.
  12. The term cheating includes, but is not limited to: (1) use of any unauthorized assistance in taking quizzes, tests or examinations; (2) dependence upon the aid of sources beyond those authorized by the instructor in writing papers, preparing reports, solving problems or carrying out other assignments; or (3) the acquisition, without permission, of tests or other academic material belonging to a member of the University faculty or staff.
  13. The term plagiarism includes, but is not limited to, the use, by paraphrase or direct quotation, of the published or unpublished work of another person without full and clear acknowledgement. It also includes the unacknowledged use of materials prepared by another person or agency engaged in the selling of term papers or other academic materials.
  14. The Vice President for Student Affairs shall be designated by the University President to be responsible for the administration of the Student Conduct Code. The Vice President for Student Affairs may designate, when appropriate, a staff member to act in his/her stead.
  15. The term Category I violations refers to allegations which, if substantiated, may result in sanctions ranging from a warning to five hours of community service per week not to exceed one semester. Category I cases are adjudicated by the Residence Hall Disciplinary Council. Its decisions may be appealed to the Vice President for Student Affairs. The Vice President for Student Affairs decision is final.
  16. The term Category II violations refers to allegations which, if substantiated, may result in sanctions ranging from 10-20 community service hours per week not to exceed one semester. Category II cases are adjudicated by the Student Conduct Panel. The Student Conduct Panel shall consist of one faculty member, two Student Affairs professionals (one shall be chair and the other shall be recorder), one other University staff member, and two students. The Student Conduct Panel decision may be appealed to the Vice President for Student Affairs. The decisions of the Vice President for Student Affairs are final.
  17. The term Category III violations refers to allegations which, if substantiated, may result in suspension or expulsion. Category III cases are adjudicated by the Student Affairs Committee. The Student Affairs Committee shall consist of a combination of 32 faculty, staff and students. The quorum shall be five voting members. The chair shall not have a vote. The Student Affairs Committee makes recommendations for disciplinary actions to the Vice President for Student Affairs. The Vice President for Student Affairs imposes sanctions. Only those sanctions imposed by the Vice President for Student Affairs of suspension or expulsion may be appealed to the University President. Suspension for one semester shall mean the student may not re-enroll until the following semester. (The student may not re-enroll during an intervening summer term.) Reinstatement after suspension is not automatic. The student must submit a letter of re-application to the Vice President for Student Affairs for consideration.
